A Minsk Woman Paid 24 Thousand Rubles For Dental Services And Was Dissatisfied

Four years ago, a woman from Minsk was provided with low-quality dentures in a dental clinic. The woman appealed to the court. The press service of Minsk City Court told how the dispute ended.

Minchanka stated in the lawsuit that in December 2021, she concluded a contract with the "Center of Dental Implantation" to provide paid medical services for treatment, implantation and prosthetics. She paid 24 thousand 365 rubles for the entire range of services, of which 14.1 thousand rubles for prosthetics.

"After the installation of implants, the woman repeatedly appealed to the Center with complaints of discomfort in the oral cavity, and also sent a claim for termination of the contract in terms of prosthetics services and return of the paid amount, which was denied," the court said.

In June 2024, "Belarusian Society for Consumer Protection" at the request of the woman appealed to the Center with a claim, in which it demanded to terminate the contract of medical services in terms of prosthetics, to return the cost of these works and materials in the amount of 14.1 thousand rubles, to compensate moral damage in the amount of 2000 rubles, as well as to repay the expenses of the public association in the amount of 338 rubles.

But the center returned only part of the money - 5628 rubles, compensated moral damage in the amount of 200 rubles, reimbursed the public association's expenses in the amount of 338 rubles.

Then the woman appealed to the court. In the framework of the proceedings, an expert examination was conducted, which confirmed the validity of the patient's claims.

"The medical workers violated the regulations of the Ministry of Health. In fact, the plaintiff could not use the results of the work performed by the defendant," the court said in its decision.

The court ruled to terminate the contract concluded by the parties in terms of prosthetic work. The Center of Dental Implantation recovered Br8,526, paid by Minsk resident under the contract, Br1,000 compensation for moral damage and Br4,812 in penalties.

In addition, the stomatology was ordered to pay Br13,339 in fines, Br713 in state duty, as well as to transfer Br3067 to the Belarusian Society for Consumer Protection.

According to the court decision, the Minsk woman must return the dentures to the center, but at the expense of the company and only "after the full repayment of the recovered amounts".
